State can issue directions to varsities: court

BANGALORE: The Karnataka High Court on Tuesday upheld the Government’s contention that it could issue directions to universities and that the latter were bound to follow them.
This order was passed on a petition by an educational institution from Mangalore challenging the refusal by Mangalore University to grant it affiliation.
The petitioner, Srinivasa Institute of Management Studies, had moved the High Court after the university refused to grant it affiliation. It said it had obtained affiliation from the All India Council of Technical Education (AICTE) as per the norms.
It said even the Government had granted affiliation and written two letters to the university asking it to grant affiliation. The institute said 60 students were admitted to the course and the university was yet to grant affiliation.
The Government advocate submitted to the court that the Government had the powers to issue directions to the university. He said the Government had twice written to the university to grant affiliation but to no avail.
Justice B.S. Patil allowed the petition and directed the university to grant affiliation to the institute.
