Court seeks explanation on quota for disabled

CHENNAI: The Madras High Court has asked the Government to explain why it had reserved only 13 lecturer posts, instead of 30, for disabled candidates, in the selection for around 1,000 vacancies in government colleges. It also sought to know why hearing impaired candidates were left out of the reservation scheme.
The First Bench, comprising Chief Justice A.P. Shah and Justice P. Jyothimani, hearing a public interest litigation petition filed by Prof. I. Elangovan of Voorhees College in Vellore, asked the government pleader to submit the details by August 21, when the matter will come up for further hearing.
The petitioner contended that while inviting applications for 1,000 lecturer vacancies in government colleges, the State ought to have reserved 30 seats for the disabled. According to him, Section 33 of the Persons with Disabilities (Equal Opportunities Protection of Rights and Full Participation) Act 1995 mandated the State reserve not less than 3 per cent of the total seats for disabled persons.
One per cent each of these vacancies should go to persons suffering from blindness or low vision, those with hearing impairment and those having orthopaedic disability or cerebral palsy.
In the September 18, 2006 notification, the Government allotted only 13 seats for the disabled, and completely excluded those with hearing impairment from the reservation scheme, he said. No hearing impaired candidate could apply for the vacancies, he said, adding the certificate verification had already been completed.
Prof. Elangovan sought to declare the impugned notification illegal.
