Kochi: Justice V. Ram Kumar of the Kerala High Court on Tuesday reserved his order on a writ petition seeking a probe by the Central Bureau of Investigation (CBI) into the custodial death of Udayakumar at the Fort police station in Thiruvananthapuram sometime back. The petition was filed by Prabhavati Amma, mother of Udayakumar. The petitioner said that during the trial, two police witnesses, T.Vijayakumar and C. Anilkumar, had turned hostile. The Director-General of Prosecutions had submitted that the Government did not have any objection to the case being handed over to the CBI in view of the sentiments expressed by the victim’s mother. Ccounsel for the CBI and the DGP submitted that there were no legal impediments in transferring the case, trial of which had already started, to another agency for further investigation. A Bench on Tuesday directed the police to ensure that there was no breach of peace on the factory premises of English Indian Clay, Thiruvananthapuram. The order was issued on a petition filed by the company seeking police protection for mining, processing and transportation of clay. The court, however, made it clear that the order shall not enable the police to interfere with the peaceful demonstrations and public meeting held to highlight the alleged illegal activities of the company.
