MADURAI: The Madurai Bench of the Madras High Court on Friday exempted suspended Deputy Superintendent of Police V. Rajaram from appearing before the Chief Judicial Magistrate here on August 28 in connection with the Sun TV attack case. The DSP was accused of not preventing a mob which threw petrol bombs on the Sun TV Network office here on May 9, killing three people. The violence erupted pursuant to a survey published by a Tamil daily, owned by the Network, against M.K. Azhagiri, son of Chief Minister M. Karunanidhi. Justice G. Rajasuria also allowed a miscellaneous petition filed by Mr. Rajaram to amend the prayer from quashing a process issued by the Magistrate to quashing of the entire proceedings against him. The petitioner’s counsel, K. Jeganathan, contended that the Magistrate ought not to have taken cognisance of the case and issued process as the Central Bureau of Investigation had not obtained State Government sanction, which was mandatory under Section 197 of the Criminal Procedure Code, to prosecute the DSP. He objected to inclusion of his client along with other accused in the case. After hearing preliminary arguments, the Judge directed S. Jayakumar, Special Public Prosecutor for CBI, to file a counter affidavit and adjourned the matter to August 28.
