NEW DELHI: The Delhi High Court has ordered an enquiry by the Central Bureau of Investigation into the death of a young man allegedly in judicial custody at Tihar Central jail here in 2004. The Preet Vihar police in North-East Delhi had arrested Mobin in 2001 in connection with a murder case that the trial court had later dismissed and acquitted all the other accused, observing that the investigating agency had foisted the case on them. Justice S.N. Dhingra directed the CBI to investigate the case on a petition by Bilkis Begum, the wife of the deceased. She urged the Court to order the CBI to investigate the case as she apprehended that her husband was tortured to death. She also sought a compensation of Rs.15 lakh, submitting that she had four grown-up children and they did have anyone to take care of them except her. The Court said it would hear her plea for compensation later. It directed the Hari Nagar police in West Delhi, where the death allegedly in judicial custody was registered, to hand over the case file to the CBI within two weeks. It asked the CBI to probe the case and file a progress report to it. Mr. Justice Dhingra said a perusal of the progress report showed that the local police had not made any substantial progress in the investigation of the case.
