SCDRC concerned over garbage pile-up

CHENNAI: The State Consumer Disputes Redressal Commission (SCDRC) on Friday said the garbage pile-up in the city is a serious situation and the consequences will be unimaginable.

“It will lead to cholera, leptospirosis, etc. It is rather unfortunate that the authorities have not realised the seriousness of the situation,” a Commission Bench comprising its President, Justice K.Sampath, and Member, Pon.Gunasekaran, observed.

The Commission was passing an order on a petition filed by Citizen Consumer and Civic Action Group, represented by its trustee, N.L.Rajah.

The petitioner urged the SCDRC to direct Neel Metal Fanalca Environment Management Private Limited, Annanagar West, represented by its General Manager (second respondent), to forthwith install adequate number of garbage bins in the Ice House, Adyar, Pulianthope and Kodambakkam zones of Chennai Corporation.

The Commission said the advocate for the second opposite party undertook to file a clear affidavit on September 3, committing itself to remove the accumulated garbage by September 5. The Commission posted the matter for September 3.

The trustee submitted that the Chennai Corporation, represented by its Commissioner (first respondent), should take action to remove garbage regularly without fail. Any default in performing this function would endanger public health.

The contract with the Chennai Corporation came into effect on August 25 and the second respondent failed to take any initiative to remove municipal waste in the four zones. The civic body failed to ensure that the company performed the contractual obligations effectively. Failure to perform the obligations amounted to deficiency in service. The complainant wanted the second respondent to pay Rs.25 lakh as damages to the State Consumer Welfare Fund for deficiency in service.
