Congress MLA released after court order
Moga: Congress MLA Joginder Pal Jain was Tuesday released from jail after the Punjab and Haryana High Court quashed his detention under the COFEPOSA Act as the order had “outlived its life”.
The High Court in Chandigarh gave the ruling on Monday on a habeas corpus petition filed by his wife Swaran Lata Jain challenging the detention as it was “illegal” and based on “vague grounds”. Jain was acquitted in the main case, for his alleged involvement in an old case of illegal money transfer registered in Kolkata, on October 29 last year by a Delhi Court, she said.
The court held that there was a delay in issuance and execution of the detention orders under Conservation of Foreign Exchange and Prevention of Smuggling Activities Act passed by the Centre in 1988 for nearly 20 years and had “outlived its life”.
It observed that the detention was “preventive and not punitive” and ordered his release. Soon after his release, the MLA went to a local Gurdwara. PTI
