Kochi: A writ petition seeking a further investigation by the CBI into the custodial death of Udayakumar at the Fort police station in Thiruvananthapuram was referred to a Full Bench by a single judge of the Kerala High Court. Justice V. Ramkumar referred the case to the Full Bench for an authoritative pronouncement on the legal question whether another investigation agency should be directed to conduct a further investigation into a case that was earlier investigated by the police. The court was of the opinion that a further investigation could be conducted by another agency. It was of the view that this was a fit case where a CBI investigation could be ordered. The judge held that the trial brought out a calculated conspiracy by the police with witnesses supporting their own breed. Udayakumar was allegedly tortured to death at the police station on September 27, 2005 The court made the reference order on a petition filed by Prabhavathi Amma, mother of Udayakumar Ragging caseThe court also stayed for three weeks the trial of the case relating to the ragging of a nursing student at the School of Medical Education Nursing College in Kottayam. The trial is scheduled for September 15. The court passed the order on a revision petition filed by the State Government against the Kottayam Sessions Court’s order discharging SME College Principal Mariyamma and Director P. Muralidharan Nair, eight and seventh accused respectively from the offences under the Prohibition of Ragging Act. Apology tenderedThe former chief of the Special Task Force constituted to oversee the eviction of the encroachers on land in Munnar K. Suresh Kumar; Ratnan Khelkhar, Sub-Collector, Devikulam; and V. Ramadas, tahsildar, Devikulam, tendered apologies for demolishing a portion of the Dhanyasree Yathri Nivas in Munnar. The affidavit filed by them said they were under the impression that there was no legal impediment in demolishing the resort in the light of the statement by Revenue Minister K.P. Rajendran in the Assembly. The Minster announced that the resort would be demolished on July 11. The affidavit was filed in response to a contempt of court petition filed by the owners of Dhanyasree Yathri Nivas for disobeying the stay order against the demolition of the hotel.
