High Court directive to CMDA

CHENNAI: The Madras High Court has directed the Chennai Metropolitan Development Authority (CMDA) to process the planning permission applications of a batch of construction firms by accepting bank guarantee instead of insisting on security/caution deposits. Justice A. Kulasekaran passed the order on a writ petition filed by Prakash Challa of Srinivasa Shipping and Property Development Limited.

Counsel for CMDA Hasan Mohammed Jinnah was asked to process the application without insisting on security deposit from the petitioner. Special Government Pleader I. Paranthaman was directed to file a counter-affidavit on behalf of the Housing and Urban Development Department within two weeks.

The petitioner, assailing Rule 19(b)III-B of the Development Control Rules for Chennai Metropolitan Area and Rule 7 of the Rules for Information Technology Park, wanted them declared ultra vires the Tamil Nadu Town and Country Planning Act. He said they must be declared illegal.
