High Court gives relief to landowners

BANGALORE: In a judgment which would have far-reaching consequences, the Karnataka High Court on Thursday struck down as ultra vires and illegal Section 20 of the Karnataka Slum Areas Improvement Act.
The Act had limited payment of compensation for land acquired under its provision, at 300 times the tax paid for the land (The compensation paid would be 300 times the tax paid on the land).
Several residents whose lands were acquired under the Act had challenged its validity, saying that it is illegal and discriminatory.
Justice Ashok Hinchigeri struck down Section 20 of the Act and said any compensation paid for land acquired would have to be according to the Land Acquisition Act.
The striking down of Section 20 will come as a relief to site and landowners whose lands are to be acquired under the Slum Act.
