Government can challenge Lalu’s acquittal: court

PATNA: The Patna High Court has upheld the Bihar Government’s right to challenge the acquittal of Railway Minister Lalu Prasad and the former Chief Minister Rabri Devi by the lower court in a disproportionate assets case and decided to hear of its petition from September 24 on the issue of admissibility.

Justice R.K. Datta rejected the claims of Mr. Prasad and his wife that the Central Bureau of Intelligence alone enjoyed the privilege to challenge their acquittal by the special CBI court, and upheld the maintainability of the State Government’s petition.

The Bench had heard arguments on the issue on September 12 and reserved its order on a petition.

Mr. Prasad challenged the State Government’s petition to challenge his acquittal by the lower court and prosecute him after the CBI decided against doing so.

The CBI court acquitted him on December 18.
