New Delhi: A practising advocate on Monday moved the Supreme Court demanding that a judicial committee be set up to probe allegations against the former Chief Justice of India Y.K. Sabharwal. In his public interest litigation petition, Manohar Lal Sharma said he was shocked at reading in newspapers allegations against Mr. Justice Sabharwal. He said he was filing the petition to protect the dignity, integrity and respect of the judiciary against a mala fide campaigning against Mr. Justice Sabharwal. He said the former Chief Justices J.S. Verma and V.N. Khare and retired Supreme Court judges V.R. Krishna Iyer and P.B. Sawant had issued a statement that a judicial probe would put an end to the controversy. Faith in judiciary“The democratic structure stands upon faith and belief of the people in judiciary. Any damage/injury to the judiciary will destroy the entire basic structure.” The petitioner said the conduct of a former judge could be enquired into under the Judges (Protection) Act, 1985, which provided for taking action against any person “who is or was a judge.”
