CUTTACK: The Orissa Consumer Disputes Redressal Commission has held guilty American Express Bank Limited; a bank incorporated in the US, for harassing its customers. The bank for deficiency in service has been asked to pay Rs one lakh as damages and compensation to a city-based senior lawyer. Bijan Ray, a senior advocate of Orissa High Court and former advocate-general of the State, was put in an embarrassing situation when the ‘globally valid credit card’ of the American bank was not honoured in some cities of US during his visit to that country in May 2000. After returning to India in July 2000, Mr. Ray applied for terminating the card and sought damages from the bank for $ 100000. But the American Express Bank in a letter to Mr. Ray in October the same year simply regretted the inconvenience caused to the couple. The bank however, refused to consider their claim for compensation saying the incidents did not occur due to any act of omission or commission by the bank. The Commission chairman Justice R K Patra (retd) and member Subash Mahtab observed that it was a clear case of deficiency in service on the part of the bank and directed it to pay the damages by November 2007. The bank is also directed to pay Rs. 5,000 towards the costs of the case.
