“Victim’s submission now not believable” The Court grants bail to the accused NEW DELHI: The Delhi High Court has refused to quash a First Information Report against three accused in a rape case, rejecting the victim’s submission that she had lodged a false case at the instance of her father to frame the three. Dismissing the plea by Raju, Ramesh and Rohit, Justice Pradeep Nandrajog said the victim’s submission now was not believable as she had not prosecuted the complaint that she lodged against her father. “The matter is vexed and not free from doubt,” Mr. Justice Nandrajog said. However, the Court granted bail to the accused on their furnishing bail bonds of Rs.20,000 each with one surety of like amount. The petitioners had sought quashing of the FIR on the ground that the girl’s father had compelled her to lodge a false case against them. They had not compelled her to give a clean chit to them as alleged by the prosecution, the petitioners submitted. The allegation against the petitioners was that they had kidnapped, confined and sexually assaulted the girl in the Uttam Nagar area of Delhi in 2003.
