BANGALORE: The Karnataka High Court on Friday reserved for orders appeals against the order of a single judge striking down the repeal of the Contract Carriages Act and quashing the contract carriage permits given to private bus operators. A Division Bench comprising Justice Chidananda Ullal and Justice Nagmohan Das had been hearing appeals by S.R. S. Travels of Kalasipalyam and 37 others, all holders of contract carriage permits. They said that on December 16 the single judge had allowed petitions by the Karnataka State Road Transport Corporation and struck down Section 3 of the Karnataka Act repealing the Contract Carriages Act as it violated Article 39 (b) and (c) of the Constitution and Supreme Court decisions. He had observed that the Government had no power to tamper with the basic structure of the Constitution and the Directive Principles of State Policy by amending the Contract Carriages Act. He had directed the State Transport Authority and the Regional Transport Authority to cancel the permits of even those private bus operators who were not before the court.
