NEW DELHI: The Delhi High Court has refused to entertain an appeal against a single-judge Bench judgment dismissing a petition challenging the appointment of Usha Thorat as Deputy Governor of the Reserve Bank of India in 2005.
Dismissing the appeal filed by P.K. Biswas, one of the Executive Directors of the RBI Board of Directors, a Division Bench comprising Justice M.K. Sharma and Justice Sanjiv Khanna said there was no infirmity in the order of the single-judge Bench. The appellant had sought quashing of the decision to appoint Ms. Thorat on the ground that his seniority was bypassed while making the appointment to the post. The appointment of Ms. Thorat was also in violation of the RBI Act, Mr. Biswas submitted.
The process of appointment had passed through all the proper channels before it reached the Cabinet Committee on Appointments for endorsement, the Bench ruled.
It, however, directed the RBI to make a comparative assessment of all eligible officers at appointment time.
