BANGALORE: The Karnataka High Court on Wednesday took a dim view of the police inaction in arresting an accused in a kidnap case merely for the reason that the kidnapper was not present within their jurisdictional limits. Expressing severe displeasure over the action of the Chikjala police, a Division Bench comprising Justice K.L. Manjunath and Justice Jawed Rahim orally observed that the question of jurisdiction should not crop up when the police have to arrest someone. PetitionThe Bench was dealing with a habeas corpus petition by a woman seeking a direction to the police to trace her son, Ramesh, who she claimed had been kidnapped on the eve of the local body elections. The Bench observed that though Ramesh had been traced, he had levelled a serious allegation against the police saying that the kidnappers had been getting information from the police themselves about the court proceedings. It noted that Ramesh had also filed an affidavit testifying to this statement. When Ramesh informed the court that a few policemen were still threatening him, the Bench asked him if the policemen were present in court. Ramesh pointed to a circle inspector of Devanahalli and said he had threatened him outside the court. The Bench asked the policemen to file affidavits and adjourned further hearing on the case.
