‘Elephant sale needs prior permission’

THIRUVANANTHAPURAM: The Chief Wildlife Warden has said that it is illegal to either buy or sell elephants without prior permission from him or an officer authorised by him.

He stated this in a press release issued here on Friday in the context of a claim by the All Kerala Elephant Owners’ Association, reported by the media, that there was nothing illegal about buying or selling elephants.

The Wildlife Protection Act of 1972 governs matters relating to holding captive elephants in the possession of individuals. Under Section 40(2) of the Act, none can buy or sell the animals that are included in Schedule 1 or Part 2 of Schedule 2 of this Act without prior permission of the authorities.

The ban on buying and selling without prior permission applies in the case of parts of such animals also.

Elephant is an animal included in Schedule 1 of the Act. The Act was amended in 2002. Under Section 43(1) of the amended Act, a person holding the ownership certificate of such an animal or animal part could not transfer the ownership to another person as a commercial transaction.
