‘Judicial activism a misnomer’
The former Supreme Court Judge K.T. Thomas, who delivered a lecture on ‘judicial activism’ at the Press Club hall organised by the Kerala University Union in the city on Tuesday, is of the view that the term is a misnomer in describing the ‘excessive’ influence, if any, wielded by the judiciary.
“Just like the way an ice-cream is always cold, a judiciary should always be active. If it is not, then the consequences for a democratic society will be grave,” he said, referring to a rather subdued role of the judiciary during the Emergency period. He suggested that the phrase be changed to ‘judicial creativity’ to convey the intended idea.
