Judge admits petition and orders notice to the Government
CHENNAI: A Dravida Munnetra Kazhagam (DMK) functionary has moved the Madras High Court, alleging assault and intimidation by the police and seeking Rs.10 lakh compensation for harassment and injury.
Justice V. Dhanapalan, before whom the petition filed by A. Duraivelu, organiser of the youth wing of the DMK and vice-chairman of the Alandur Municipality, came up for hearing, admitted it and ordered notice to the Government.
According to the petitioner, he and his supporters had gone to Perambakkam village on September 5 in connection with panchayat elections.
Though members of rival political parties were indulging in unlawful activities, the local police did not make attempts to maintain law and order. Instead, they questioned the petitioner and his supporters, abused and assaulted them.
A senior police officer threatened to shoot them.
Stating that the police action was in violation of Supreme Court decisions and provisions of the Constitution, the petitioner said the lathi-charge was indiscriminate and without warning.
He sought Rs.3 lakh interim compensation, and Rs.10 lakh towards final compensation for police excesses and assault.
