Realtor asked to pay compensation Consumer notes

VISAKHAPATNAM: A real estate company found guilty of deficiency in service has been directed by the Visakhapatnam District Consumer Forum-I to repay the money collected from a consumer with interest, compensation, and costs.

A resident of Ukkunagaram, Poonam Dhawan, joined Siri Gardens layout scheme of Gruhajyothi Building and Estates Private Ltd., at Old Gajuwaka Junction, to purchase a house-site. She paid a sale consideration of Rs.50,200 in instalments between January and July in 2003. Subsequently, she came to know that the realtor failed to obtain the necessary permission and was dodging the registration to make wrongful gain. She stopped further payments and sought refund. When she was not repaid, the consumer filed a complaint (629/2007) in the Forum against the realtor represented by its Managing Director Y. Ramabrahmam, chairman M. Krishna Rao and manager M. Srinivasa Rao, seeking compensation for mental agony and costs.

President of the Forum Y. Dhilleswara Rao, and members G. Viswanatha Reddy and D. Suseela, who examined the case earlier this week observed that the opposite party, having floated the scheme, received substantial amounts from the complainant but railed to obtain necessary approvals from the competent authorities though the instalments were collected since the year 2003. These circumstances were proof positive that there was deficiency in service, they held.

In the result, the realtor was directed to repay Rs.50,200 along with Rs.5,000 towards compensation for mental agony and Rs.1,000 as cost of litigation.

The Forum further directed the opposite party to pay 12 per cent annual interest on Rs.50,200 from July 24, 2007 till the date of realisation.
