High Court upholds land acquisition for Butterfly Park near Bangalore

BANGALORE: The Karnataka High Court on Monday upheld the acquisition of land for setting up the Butterfly Park and dismissed a petition by two residents of Byrappanahalli village laying claim to the land.

In their petition, Hanumappa and another person, both of Byrappanahalli in Jigani of Anekal taluk, Bangalore rural district, said they were the owners of land with survey numbers 8/2 and 8/3, adjacent to the Bannerghatta National Park.

They said though a civil court had passed an injunction order on the land in their favour, the authorities had not acted on it. Instead, they were about to take possession of the land.

On its part, the Government said the land had been acquired long back and that the land acquisition proceedings were completed in 1990. The land, which forms part of the National Park, is now earmarked for the Butterfly Park. It said the RTC (revenue records) of the land stands in the name of the National Park.

Moreover, the mutation entry (entry of names in the land register) of May 27, 1993 passed by the Tahsildar is also in the name of the National Park. The High Court as well as the Supreme Court had already upheld the acquisition. However, the petitioners had suppressed these facts and obtained an order in their favour from a civil court.

Justice Mohan Shantangouder upheld the acquisition of the land for the Butterfly Park and agreed with the Government stand that the petitioners had suppressed certain facts before the civil court.

Quashed

Justice K. Ramanna on Monday came down heavily on the Karnataka State Road Transport Corporation (KSRTC) and others for registering a criminal case against doctors, advocates and policemen several years after a Motor Accidents Claims Tribunal (MACT) had passed an award in a motor vehicle claims case. The KSRTC and the State had claimed that the documents pertaining to the accident of a KSRTC bus at Nelamangala were fabricated and that false claims for compensation were made.
