Three more sentenced to life in serial blasts cases

A total of 43 persons have been awarded life term

Those in custody to get judgement copy by October 29


Coimbatore: Three more persons were sentenced to life imprisonment in the Coimbatore serial blasts cases on Friday. With this, the total number of persons sentenced to life has gone up to 43.

Judge of the Special Court for Bomb Blast Cases K. Uthirapathy awarded sentences to five persons.

While two of them were given double life terms, one was given a single life term and two others, 13 years Rigorous Imprisonment (RI), besides imprisonment ranging from three to nine years for individual offences.

The sentences would run concurrently.

The Judge also observed: “The trial has been concluded, the judgment, inclusive of the sentences has been pronounced and the status of the approver Riaz-Ur-Rehman cited as a prosecution witness has to be determined. The witness/approver Riaz-Ur-Rehman has let in evidence, which, on analysis, is in the nature of supporting neither side.

“The special public prosecutor had neither chosen to seek permission to treat the witness as hostile nor has chosen to make any application before the court to launch any criminal proceedings against him.

“In such circumstances, this court had to deem it that the approver has discharged his liabilities. This court deems that the deposition of the approver in this case is in conformity with that of the deposition made by him before the Judicial Magistrate Court V.

“Further, there is neither any application nor any certificate from the Special Public Prosecutor that Riaz-Ur-Rehman has either wilfully concealed anything or given any false evidence or that he has not complied with the conditions under which the tender of pardon was made. So he is entitled for discharge in this case”.

The approver is facing trial in a bomb recovery case before the same Special Court and before the Special Court at Poonamalee for cases relating to explosives/explosions on trains at Tiruchirapalli, Thrissur and Erode.

The court passed orders on the issue of protection, confiscation and destruction of material objects and exhibits and said a decision could be taken after the expiry of time for going in appeal.

Notices

The court also said that those in judicial custody would be provided with a judgment copy by October 29. Notices would be sent to those released on setting off of the trial period against the sentence for collecting the judgement copies.
