Court notice to Ilyasi, police

NEW DELHI: The Delhi High Court on Friday issued notices to television anchor Suhaib Ilyasi and the Delhi police on a revision petition filed by Rukma Singh, mother of Suhaib’s late wife Anju Ilyasi, seeking investigation into alleged discrepancies in the probe conducted by the police in the death of her daughter in 2000.

Justice S. Muralidharan directed the respondents to file replies to the petition by January 15, 2008. The Court also summoned the records of the case from the trial court.

Ms. Singh filed the petition against a trial court judgment in August this year dismissing her petition for a further probe of the case.

The Additional Sessions Judge trying the case had dismissed her application saying he could not hear it as another judge seized of the trial had already decided a similar application filed by the prosecution.

The trial court is at present recording evidence of prosecution witnesses in the case at the Karkardooma courts here.The prosecution had sought trial of Suhaib for the murder charge on the ground that one of the doctors of the medical board had opined that homicide could not be ruled out in the case and Rukma Singh and the doctor who had treated her at Virmani Hospital had also given enough hints in their statements that it could be a case of murder. Dismissing the plea, ASJ Chandra Gupta had said that there was no fresh material brought on record by the prosecution to try the accused under Section 302 of the Indian Penal Code.
