Inspector, four constables ordered to pay Rs. 60,000 as compensation

CHENNAI: The State Human Rights Commission has ordered an Inspector and four constables to pay a person Rs.60, 000 for causing him mental agony by taking him from Tiruchi to Madurai and coercing him to accept his liability in a civil transaction.
Abandoning their lawful duties, “they had involved themselves in extracting the signature of Sureshkumar [complainant] on a blank bond and stamp papers with a view to compelling him to accept a civil liability,” a Bench of Justices S. Thangaraj and K. Mariappan, both Members, said.
The Commission said M. Ramasamy, the then Inspector of Police, Avaniyapuram station, should pay Rs.20,000 and constables, K. Kaliraj, Subbiah, D. Muthupandiyan and R.Duraipandian, Rs.10,000 each.
The State Government should pay the compensation and recover the amount from their salaries in instalments.
J. Sureshkumar of Tiruchi lodged the complaint through his advocate S. Sivasankaran. In February 2004 he was forcibly taken by the Avaniyapuram police from his home and detained at the station.
They also obtained his signature on a stamp paper worth Rs.100 and two white papers and a bond paper.
In his report, the Superintendent of Police, Madurai, confirmed the episode.
In their counter, the respondents denied it.
The Bench rejected the respondents’ argument that the contentions of the telegram (complaint) to the Commission were false and frivolous.
The Bench said it was clear that there was a civil dispute between Shanmugalal and Sureshkumar, with the latter liable to pay dues in a business transaction.
