Wakf Board: draft regulations framed

Administration of properties may be a smooth affair

Hyderabad: Administration of Wakf properties in the State is expected to be a smooth affair with the Wakf Board coming up with two draft regulations on constitution of management committees and area supervisory committees. At present there is no specific rules for constitution of committees under the Wakf Act, 1995.

This has led to a large number of litigations piling up in the High Court and the Wakf Tribunal.

The Wakf Board recently set up a 7-member expert committee headed by Prof. Ahmedullah Khan, an authority on Wakf Acts, to suggest guidelines for bringing out a regulation to address the needs of the Board.

The draft regulations will be discussed at a workshop being convened on November 25 by Muslim MPs, MLAs and religious scholars and after incorporating their suggestions the final draft will be sent to Government for approval, said Ariz Ahmed, Special Officer, Wakf Board.

In most cases where committees are constituted for management and supervision of Wakf institutions, there is no uniformity with regard to the number of members and office bearers. Some committees have 9 members, some 11 while a few 13.

On several occasions the High Court also found fault with the way the management committees are constituted.

Therefore, the Board felt it desirable to formulate terms and conditions for constitution of the committees, it is said.

They also touch upon their functioning with specific reference to their powers and duties.

“It will be like a handbook for quick reference and easy understanding”, says Prof. Khan, former Dean Faculty of Law, Osmania University.

“Now there will be no confusion and we will be able to concentrate on development works”, says Mr. Ariz Ahmed.
