NEW DELHI: The Delhi High Court on Tuesday refused to grant bail to an accused in a murder case borne of a road rage incident at Uttam Nagar in West Delhi last year.
Dismissing the plea by Shanky Mahajan, Justice V. B. Gupta said that keeping in view the seriousness and gravity of the offence and prima facie involvement of the petitioner, no ground was made out for granting bail.
The Uttam Nagar police had registered the case on the statement of a witness to the incident. The police have already charge-sheeted the accused. The trial court is recording statements of prosecution witnesses.
According to the charge-sheet, a few hours after the accused had threatened to kill a scooterist during an altercation over his car hitting the two-wheeler, some persons had stabbed the scooterist to death in the absence of the accused.The accused had sought bail on the ground of absence of the petitioner at the scene of the crime.
Opposing the plea, the prosecution said when the presence of the accused petitioner was established during the first incident, his involvement in the murder of the scooterist could not be denied.
