BMC Commissioner talks tough

Mulls legal action against people creating public nuisance


User fee fails to deter people from throwing debris on streets

List of offenders to be published in newspapers


BHUBANESWAR: After the Bhubaneswar Municipal Corporation’s (BMC) user fee concept failed to deter citizens from creating public nuisance, the civic body has decided to take recourse to legal action.

Before serving legal notices, the BMC is all set to make public names of those who have not responded to repeated warnings of the corporation.

A list comprising names of 14 persons accused of creating public nuisance would be published in newspapers soon, BMC Commissioner Aparajita Sarangi said.

So far, the civic body was going soft since it was trying to educate people about the punitive action that could be taken for causing unhealthy atmosphere. The corporation’s action had been limited to issuing notices.

“Several people have turned a deaf ear to our repeated warning. We will be publishing their names in newspapers. If they are still adamant, the corporation will then register cases against them under CrPC,” Ms. Sarangi said.

The rule

It may be recalled that the BMC decided to impose user fee on those who use public places for more than 24 hours. As per the guidelines, no person shall be allowed to stack building material or debris on streets for construction, alteration, repair or demolition work. Discharge of filthy water onto public roads was also construed as an offence.

Violators were first served a seven-day notice to mend their ways. When they did not respond, a ‘red notice’, which was the final warning, was served on them. Ward officers were asked to report public nuisance.

The corporation issued notices to 369 persons so far. Out of them, only 104 responded and the rest ignored the warning. “We have no other option but to register cases against them,” the BMC Commissioner said.
