NEW DELHI: Reiterating its 2002 directions banning strikes in the Capital’s hospitals, the Delhi High Court on Wednesday directed the Centre and the Delhi Government to take action against their hospital employees if they go on strike. The unions of employees of government hospitals here have issued a call for a strike for different reasons and durations on Thursday. A Division Bench of the Court comprising Justice M. K. Sharma and Justice Sanjiv Khanna passed the order on public interest litigation by social activist Salek Chand Jain. He submitted that medical and non-medical staff in government hospitals here resort to strikes on petty grounds without making efforts to get their complaints redressed by raising them on proper platforms. Further, he said, the strike call issued by the unions was contrary to the Supreme Court and High Court orders passed earlier prohibiting striking of work by hospital employees. The petitioner urged the Court to direct the governments to invoke the Essential Services Maintenance Act if the employees go on strike. SubmissionAgreeing with the petitioner’s submission, the Bench directed the governments to take action against their employees if they violate the orders.
