Apex Court declines to interfere with order

New Delhi: The Supreme Court has declined to interfere with an order passed by the Madras High Court directing the Enforcement Directorate to return the passport to V. Bhaskaran, relative of N. Sasikala, a close aide of the AIADMK General Secretary, Jayalalithaa.

In its brief order dismissing the special leave petition filed by the Enforcement Directorate against the impugned order, a Bench of Justice S.B. Sinha and Justice H.S. Bedi said “the Additional Solicitor General [R. Mohan] relies upon a purported order of extension [to retain the passport] passed by the Director of Enforcement on March 14, 1996. The said document was not filed before the High Court as it appears from the impugned judgment.”

Mr. Bhaskaran was arrested for FERA violation and his passport seized.

Under the provisions of FERA, the department could retain the seized passport only for a year.
