BANGALORE: The Karnataka High Court on Friday came to the rescue of 127 diploma students and permitted them to write the annual examination scheduled to commence from November 19. Justice N.K. Patil passed the order on petitions by Rajiv Gandhi Memorial Polytechnic of Malathalli and 127 of its students. The petitioners, Ashwini, Chitra, Pooja and 124 other students, said they had not been given hall tickets to appear for the examination. They urged the court to come to their aid and direct the authorities to permit them to appear for the examination. The Government claimed that the institution had unilaterally shifted its premises from Basavanagudi to Malathalli. It said such a move was akin to starting a new institution and, therefore, permission of the All India Council of Technical Education (AICTE), was necessary. No such permission had been obtained, it said. In an interim order, Justice N.K. Patil permitted the students to appear for the examination and adjourned further hearing on the petition. NoticeA Division Bench comprising Chief Justice Cyriac Joseph and Justice Ashok B. Hinchigeri on Friday ordered issue of notices to the State and other respondents on a public interest litigation (PIL) petition by a Bangalore-based advocate, Nagaraja. The petitioner claimed that a Minister in the previous Government had permitted 73 D.Ed. colleges even after the academic year had commenced. AdjournedA Division Bench comprising Chief Justice Cyriac Joseph and Justice Ashok B. Hinchigeri adjourned further hearing on a petition by Shankar Munavalli of Belgaum seeking a Central Bureau of Investigation (CBI) investigation into allegations of corruption against the then Chief Minister H.D. Kumaraswamy and some of his ministerial colleagues. The petitioner said he has a right to be governed by persons of integrity and since allegations had been made against some members of the present coalition, they needed to be investigated. StayedA Division Bench comprising Chief Justice Cyriac Joseph and Justice Ashok B. Hinchigeri on Friday stayed a single judge order relating to mining lease in Donimalai range in Bellary district. The single judge had stayed a March 15, 2003 notification relating to issue of mining permits in Donimalai range. M. Srinivasulu and another person had filed an appeal against this order. The appellants claimed that they were in no way involved in the case that is pending before the court. They said the stay by the single judge had affected their mining operations.
