BANGALORE: The Karnataka High Court has adjourned a batch of petitions by managements of private medical, dental and engineering colleges imparting education in other professional courses, and students challenging the fee structure. While the managements have sought enhancement in the fee fixed by the then Fee Fixation Committee, the students say that they would pay the fees fixed by the committee and not the management. Several non-Karnataka students have challenged the consensus arrangement on fee structure arrived at by the managements and the Government. The students say that as per the Supreme Court ruling in the P.A. Inamdar case, there should be a uniform fee structure. However, while the fees of the students from within the State was subsidised under the agreement, they had to pay a much higher fee. Initially, the cases relating to the fee structure were being heard by the First Court headed by Chief Justice of Karnataka Cyriac Joseph. It was subsequently posted before a Bench comprising Justice S.R. Bannurmath and Justice A.N. Venugopala Gowda. When the matter came up before the Bench headed by Justice Bannurmmath, it decided to request the Chief Justice of the High Court to post the case before a new Bench. This was so because Mr. Gowda felt that he could not hear the petitions as he had appeared on behalf of the Government and argued the case when he was the Principal Government Advocate.
