From dealing with poromboke land

MADURAI: The Madras High Court on Thursday restrained the former Tamil Nadu Congress Committee president, Kumari Ananthan, from dealing with 1.1 acres of poromboke land, in Radhapuram taluk in Tirunelveli district, alienated in his favour by an August 22, 2007 Government Order.
A Division Bench of Justice F.M. Ibrahim Kalifulla and Justice S. Palanivelu granted the interim injunction on a public interest litigation petition filed by a villager before the Madurai Bench challenging the order.
The petitioner, S. Mahalingam, said the government property was assigned to an individual in 1961 who sold it within three years in violation of the conditions of assignment. Subsequently, the MLA’s father bought the property and gifted it to him in 1986.
‘Patta’ refused
A year later, the then Radhapuram Tahsildar refused to grant ‘patta’ in favour of the MLA and cancelled the 1961 assignment for violations.
In 2003, the High Court dismissed a writ petition filed by the MLA against the Tahsildar’s order and directed him to approach the Revenue Divisional Officer. Thereafter, the G.O., alienating the property for Rs.80,950, was passed based on the recommendations of the Tirunelveli Collector.
“Against the poor”
Claiming that the market value of the property was Rs.1.3 crore, the petitioner said the alienation was against the interests of the landless poor who were entitled to such poromboke land.
