Court pulls up police for ‘lopsided’ investigation

For facilitating politician to elude murder case

MADURAI: The Madras High Court has rebuked a Deputy Superintendent of Police for conducting “lopsided” investigation and facilitating a “politically influential” person to elude a murder case.

Allowing a petition filed by the victim’s wife before the Madurai Bench, Justice A. Selvam directed the Home Secretary and the Director General of Police to initiate appropriate action against the DSP Anbunesan of Jeeyapuram Division in Tiruchi district.

“The conduct of the investigating officer is not only deplorable but also condemnable. The final report filed by him is a textbook example of misuse of power and also abuse of process of law,” the Judge said.

He ordered that the investigation in the murder case shall stand transferred to the Crime Branch-CID.

The petitioner, P. Umarani of Somarasanpettai in Tiruchi said that her husband, Purushothaman, was hacked to death by a gang led by a local politician, Palaniandi, on July 29.

The police initially registered a case against all the accused based on a complaint lodged by her.

But the DSP excluded Palaniandi from the case while filing the charge sheet and hence, the present petition.

After perusing the case diary, final report and other connected documents the Judge said:

“It goes without saying that the investigating officer has created certain documents as if some of the eye witnesses have been re-examined so as to facilitate the prime accused to escape from the clutches of law.”

Over all, the investigation has not been done with regard to the complicity of the crime, Mr. Justice Selvam said quoting an anonymous poet who said: “The law locks up the man or woman — Who steals the goose from off the common; — But lets the greater felon loose — Who steals the common from the goose.”
