Problems of penology and reform and rehabilitation of criminals dominated the debate in the Rajya Sabha on November 26 on the Bill to provide for the release of offenders on probation or after due admonition. There was a sharp division of opinion on the proposal to vest in courts discretionary powers in this respect. While one section of the House felt that the release of persons on probation should be confined to the first offenders only, others were of the view that the whole matter should be left to the discretion of the courts, without laying down any hard and fast rule so that all the attendant circumstances in each case might be taken into account. The debate also evoked a warning from some members that jails should not be made attractive and that punishment should continue to be deterrent. The need for appointment of suitable persons as probation officers and giving them proper training in psychology and psychiatry was also stressed.
