Directive on penal tax

HYDERABAD: A Division Bench of the A. P. High Court comprising acting Chief Justice Bilal Nazki and Justice Ramesh Ranganathan on Friday declared that the government could not levy additional penal tax on vehicles plying in the State in the name of new provisions of the statute without issuing proper notification and putting in place proper machinery.

It was disposing off a batch of 75 writ petitions filed questioning the constitutional validity of new amendments to the MV Act that provide for the penal taxes to be levied upon vehicles that violate the permit conditions.

The Bench upheld the constitutional validity but felt that the notifications were not proper and the machinery for adjudication of the issues in this regard has not been provided.

It directed the refund of the amounts collected from operators in this regard.
