Doctors’ stir: court notice to government, KGMOA High Court Round-up

Kochi: A Division Bench of the Kerala High Court on Saturday issued notice to the State government and the Kerala Government Medical Officers’ Association (KGMOA) on a writ petition seeking a direction to declare illegal the ongoing strike by doctors in the State.

The Bench comprising Chief Justice H.L. Dattu and Justice K.M. Joseph issued the notice when a writ petition filed by S. Ganapathy of Kollam, a doctor, came up before the court.

The petition sought a direction to the State government to invoke the Essential Service Maintenance Act (ESMA) in the health services.

Abhaya case

Justice R. Basant has adjourned to December 17 the hearing on a petition challenging the Ernakulam Chief Judicial Magistrate Court’s order issuing notice to the father of Sister Abhaya, Mr. Thomas in a case seeking to produce the narco-analysis test conducted on the suspects.

The petitioner, Jomon Puthenpurackal said that after the final hearing was over, the case was posted for orders on November 26.

However, the magistrate court issued notice to the father of Abhaya without passing a final order on that day. He alleged that the order was deferred to protract the matter.

The petition also sought a direction to the CBI to produce the entire progress report on the investigation of the Abhaya case before the court and to give appropriate direction for speedy investigation.

Police protection

Acting on another petition, the Bench directed the police to provide sufficient police protection to the United Democratic Front (UDF) members of the Kottayam district panchayat for participating in the discussion on a no-confidence motion moved against district panchayat president K.P. Sugunan. The motion will be taken up for debate on December 3.

The order was passed on a petition filed by Lerader of the Opposition in the panchayat Thomas Kunnappally and 12 other members. The petition apprehended that the UDF members would either be kidnapped or prevented from attending the discussion on the motion as part of a move by the CPI(M) and the CITU leaders to defeat the motion against the panchayat president.
