Validity of Section 8(4) of RP Act challenged

New Delhi: The Supreme Court on Wednesday admitted a public interest litigation petition challenging the constitutional validity of Section 8 (4) of the Representation of the People Act under which a person would not be disqualified from being a member of the State Legislature or Parliament after conviction in a criminal case. A Bench of Justices C.K. Thakker and J.M. Panchal, while admitting the petition filed by advocate Basant Kumar Chaudhary, said it would examine the important questions of law raised in it.

Ultra vires

The petitioner contended that Section 8 (4) was ultra vires the Constitution.
