Contempt proceedings against State closed
Special Correspondent
CHENNAI: Contempt proceedings initiated against the State Government and the Ministry of External Affairs for “failure” to implement court orders to bring back the body of a Tamil youth murdered in Malaysia, were closed by the Madras High Court on Friday. The First Bench, comprising Chief Justice A.P. Shah and Justice V. Ramasubramanian, however, said they would keep the writ petition relating to the matter pending.
When the matter was taken up, advocate N.G.R. Prasad said they wanted a direction not to Malaysian authorities but to the Government of India.
Assistant Solicitor-General P. Wilson submitted that the Ministry of External Affairs had initiated all steps to resolve the issue.
The Centre, citing the Malaysian authorities, submitted in its counter-affidavit that S. Suseendran had committed suicide and that his friends had claimed the body from the hospital and cremated it without informing his family members and the High Commission of India in Malaysia.
R. Rajagopal, counsel for the High Commission of Malaysia in India, submitted that the Government of Malaysia would extend full cooperation to ascertain the circumstances surrounding the death and subsequent developments.
When a report, published in The Hindu, highlighting the lack of progress in the matter was brought to the notice of the court by Mr. Prasad, the First Bench initiated contempt proceedings.
