Court summons senior MCD officer

Refusal to implement court order on resumption of demolition


The Bench had last month directed civic bodies to chalk out an action plan to resume demolition

NEW DELHI: The Delhi High Court on Tuesday summoned in person the Additional Commissioner (Engineering) of the Municipal Corporation of Delhi for refusing to implement immediately its order for resumption of demolition of unauthorised constructions on the ground that there was a need to carry out a fresh survey of these properties.

A Division Bench of the Court comprising Justice A.K. Sikri and Justice Rekha Sharma asked the Additional Commissioner, Naresh Kumar, to be present in the Court on December 18, the next date of hearing.

The Bench had last month directed the MCD, the New Delhi Municipal Council, the Delhi Development Authority and other Government agencies to chalk out an action plan to resume demolition of unauthorised constructions.

It had directed the Court-appointed Monitoring Committee for overseeing demolitions to convene a meeting of the MCD, NDMC, DDA, Public Works Department, Central Public Works Department, the Land & Development Office and the Revenue Department of the Delhi Government to fix a time frame for resuming demolitions.

The Bench summoned the Additional Commissioner on an application by the Monitoring Committee stating that the civic body was dithering on implementation of the Court order on the pretext of carrying out a fresh survey of the unauthorised constructions, Board examinations of Class X and XII students and the onset of winter. The Bench had in particular directed the civic bodies, the DDA and the other agencies concerned to target fourth and fifth floors of properties which were not protected under any law.

The Court has been hearing a public interest litigation by Kalyan Sanstha Social Welfare Association in the matter.
