CHENNAI: The Madras High Court on Thursday reserved its orders on a modification petition filed by the AIADMK MP, N. Jothi, seeking the deletion of an anticipatory bail condition that he deposit over Rs. 10 lakh within four weeks. Justice T. Sudanthiram reserved the orders, after orally observing that the prayer in Mr. Jothi’s petition was in the nature of a review plea and that the court would not review the earlier order. Mr. Jothi, appearing as party-in-person, insisted that he should be permitted to argue “the circumstances under which the court passed the December 3 order.” He said he was “surprised, aggrieved and pained” by the order, and that the court must modify the order by deleting the condition relating to cash deposit. To this, Mr. Justice Sudanthiram said the court had passed its order, and that it would not entertain an appeal or review against its own order. “This court has passed an order, and no appeal will lie here.” Making it clear that he would not refer the matter to any other Judge, he said, “you are now before the same court with certain remarks. If you feel aggrieved and feel that the court has forced you to offer the deposit you can approach a higher judicial forum against the order.” Mr. Jothi, calling the Judge by name, said he be allowed to argue the matter and that the court reconsider its earlier order. He reiterated that it was only a modification petition and not a review plea. He said the court had “forced and pressured him” to offer the deposit, and added, “the court should not injure the interests of the party before it.” The matter relates to Mr. Jothi’s anticipatory bail plea, apprehending arrest in connection with a case registered by the CB-CID. The prosecution case is that the AIADMK MP travelled to New Delhi nine times burdening the exchequer to the tune of Rs. 2.32 lakh, and that he stayed in a Tamil Nadu House suite for months together without paying rent of over Rs. 7.95 lakh.
