Court dismisses PIL plea

“Diverting private buses to ferry DMK cadre will deprive people of their right to transportation”

Senior counsel for DMK denies that any route vehicle is being diverted for the conference


CHENNAI: The Madras High Court on Thursday dismissed a public interest litigation petition, seeking to restrain the authorities concerned from permitting private bus operators to divert their buses to Tirunelveli, where the DMK youth wing meeting is to be held on December 15 and 16.

The First Bench comprising Chief Justice A.P. Shah and Justice V. Ramasubramanian dismissed the petition. The petition was filed by former AIADMK Minister D. Jayakumar, saying that “we are of the view that it is not a case for invoking the jurisdiction of this court.”

When the matter was taken up for hearing, P.H. Manoj Pandian submitted that the petitioner was not against the conference and that diverting private buses to ferry the DMK cadre would deprive the general public of their right to transportation.

While R. Viduthalai, senior counsel for the DMK, denied that any route vehicle was being diverted for the conference, Advocate-General G. Masilamani said the PIL petition sought a pre-emptive and anticipatory relief on the basis of vague allegations.

The petitioner presumed that the Government was going to violate the law, he said, adding that such a prayer could not be countenanced by the court.
