NEW DELHI: The Employees State Insurance Corporation (ESIC) has approved an amnesty scheme for withdrawal of cases against defaulting employers and employees. This was decided at the 141st meeting of the Corporation, chaired by Minister of State for Labour and Employment Oscar Fernandes in his capacity as chairman of the Corporation here on Tuesday. The scheme will come into force from January 1 and remain effective till December 31, 2008. Cases filed in the First Class Judicial Magistrate Courts for non-payment of contribution will be considered for withdrawal, subject to payment of the contribution due and statutory interest. The quantum of relief in damages leviable/levied to the extent of 75 per cent as specified under Regulation 31-C will be provided to the employers and the damages leviable/levied to the extent of only 25 per cent will be claimed from the employers. The employers will have to give an undertaking that they will be regular in compliance in future and there will not be any default on their part.
