High Court throws out pharma firms’ case

BANGALORE: The Karnataka High Court on Thursday dismissed a petition by Vivek Pharmachem (India), Stallion Laboratories and Nicholas Piramal, which had challenged the refusal of the State Government to accept their tenders for the supply of Vitamin A supplement to children in the State under the National Reproduction and Child Care Programme.

The petitioners had said that though they had quoted the lowest prices, their tenders were overlooked in favour of other firms.

Opposing their contention, the State submitted that the tenders had already been awarded and that if the High Court continued the stay it had already given earlier, it would affect the health of 45 lakh children in Karnataka.

The State said these supplements were to be given to children from nine months to three years of age and that it is very essential for their development. Moreover, if the programme is not implemented within the time frame, it would affect the future of the children.

Justice S. Abdul Nazir accepted the contention of the State and dismissed the petition.

Dismissed

A Division Bench comprising Chief Justice Cyriac Joseph and Justice Ashok B. Hinchigeri dismissed a public interest litigation (PIL) petition seeking a direction to the authorities to preserve and protect Lake Chennapatna in Hassan.

Contempt dropped

A Division Bench comprising Justice Chidanand Ullal and Justice H. Billappa on Thursday dismissed a contempt petition against some officials of the Education Department after the Government said it had initiated steps to recruit the physically challenged to posts of schoolteachers. It said three of the six persons who filed contempt petitions are also eligible for the posts of teachers and that they would be appointed shortly.

Permitted

Justice Mohan Shantangouder on Thursday permitted 60 MBA students and 60 MCA students of Acharya Institute of Technology to take up examinations scheduled to be held from December 29.

The students had petitioned the court after the authorities refused to permit them to appear for the examination.
