One cannot agree more with the need for the judiciary to observe restraint in the larger interest of upholding the constitutional balance (“A philosophy of judicial restraint,” Dec. 19). A classic example of judicial overreach is over the issue of 69 per cent reservation in Tamil Nadu. In spite of being included in the Ninth Schedule, the Act has not been cleared by the Supreme Court. It has, instead, ordered the creation of additional seats, which in effect amounts to negation of the spirit of the Act. It has been dragging its feet on the issue for years without an end in sight.
