AIADMK leader’s election upheld

CHENNAI: The Madras High Court has upheld the election of T. Malaravan of the AIADMK from the Coimbatore West Assembly constituency.
Dismissing an election petition from A.S. Maheswari of the Congress, Justice M. Chockalingam said: “The petitioner cannot say that there exists a cause of action or a triable issue on which a trial could be conducted.” In a case like this, the only triable issue is whether the election of the returned candidate can be declared void and invalid on the ground that the result of the election of the returned candidate has been materially affected by the improper acceptance of his nomination. The petitioner, contending that Mr. Malaravan’s declaration about his educational qualification was false and misleading, said his nomination had been improperly accepted by the authorities.
