Shift detainee from jail to juvenile home: High Court
Staff Reporter
MADURAI: The Madras High Court has issued an order to shift a juvenile, detained under the Goondas Act by the Karur Collector, from the Tiruchi Central Prison to a juvenile home here.
Admitting a habeas corpus petition filed by the father of the juvenile offender before the Madurai Bench, Justices S. Ashok Kumar and S. Palanivelu said that lodging the juvenile along with hardened criminals would spoil his character and adjourned the case to January.
The petitioner’s counsel, R. Alagumani, produced the school transfer certificate of the juvenile to prove that he was only 17 years and five months old.
He sought to quash the detention order on the ground that the Collector had wrongly mentioned the detainee’s age as 20 years.
The Additional Public Prosecutor said that the detainee was involved in many motorcycle theft cases.
He also doubted the genuineness of the school transfer certificate and sought time for verification.
