‘Economic backwardness not the only criteria to consider castes as BCs’

Supreme Court action on inclusion of Kapus in BC list recalled


HYDERABAD: Retired High Court judge B.S.A. Swamy said he would challenge, in a court of law, the committee proposed to be constituted by the State Government to look into the demand for the inclusion of Kapus in the list of Backward Classes.

Justice Swamy, who is an advisor of the National Union of Backward Classes, stated at a news conference here on Tuesday that the committee would not stand legal scrutiny as it would come into existence when a constitutionally appointed commission which was already functioning to look into the exclusion and inclusion of castes in BCs. The Government had no power to set up the committee, he said.

Criteria

He also said the Constituent Assembly had made it clear during a debate that economic backwardness was not the only criteria to consider castes as BCs. The caste groups should be identified by trades to qualify as BCs. The principle of ‘shudra’ and ‘non-shudra’ should form the basis of dividing the castes.

In his view, Justice Swamy believed that castes should be recognised as BCs going by parameters such as poor hygiene, adherence to superstitious beliefs, lack of education and isolation from village communities. He recalled that the Supreme Court and the Anantaraman and Muralidhar Rao Commissions for BCs had struck down the demand of Kapus for inclusion among BCs in the past.

He challenged the Kapus for a public debate to verify their claims for inclusion in the list of BCs. The decision should be made democratically, he said.
