Seeks Delhi police’s response in 4 weeks “The Executive should have worked out mechanism”
NEW DELHI: The Supreme Court has issued notice to the Centre and the Delhi Government on a public interest litigation petition challenging the Delhi High Court’s order directing imposition of Rs.500 as cost on every traffic violation in addition to the fine amount.
A three-judge Bench of Chief Justice K. G. Balakrishanan, Justice R.V. Raveendran and Justice J. M. Panchal also sought the response of the Delhi police in four weeks on the petition filed by the All India Goods Transport Association.
The petitioner contended that the mechanism to work out the cost had to be undertaken by the Executive and there was no basis for the High Court to come to the conclusion that the cost on every challan would be Rs.500 in addition to the fine. It questioned the High Court direction appointing an expert committee to submit reports to the Court every month on traffic regulation.
The petitioner contended that it not only amounted to the High Court usurping to itself the powers of the Executive and Legislature but also raised a question mark on the locus standi of such a committee.
It also assailed the High Court’s direction to set up another committee that would decide who should be permitted to have “dark films” in the window and windscreen of the vehicles. The Association said that the Court-appointed committee should not be allowed to take a decision on this vital question as it also related to security of VIPs.
