Says he is ill, unable to testify NEW DELHI: A Mumbai-based defence witness in the BMW hit-and-run case who had claimed in a television interview that eyewitness Sunil Kulkarni was not in Delhi on January 10, 1999, the day the tragic incident took place, has informed a court here that he is ill and not in a position to testify. His testimony is now likely to be recorded on January 15. Additional Sessions Judge Vinod Kumar postponed Gauri Shankar Tiwari’s testimony after receiving a medical report through post which said Tiwari was being treated in Mumbai. Meanwhile, the defence examined the bureau chief of India TV from Mumbai and the cameraman who had recorded the interview. The bureau chief told the court that he recorded the interview of Tiwari, who questioned Kulkarni’s claims, in “public interest” and after verifying the credibility of the interviewee. He also refuted the prosecution’s suggestion that he had interfered with the process of justice by interviewing Tiwari. Earlier, the court had allowed the defence to examine Tiwari and the journalists after the defence cited the interview. Prime accused Sanjeev Nanda had allegedly mowed down six persons, including three policemen, under his BMW on the fateful night on Lodhi Road. Kulkarnihas made several flip-flops in his testimonies.
